Search and Seizure
Staff members will use a metal-detecting wand each morning to check each student for contraband. If the metal detector is activated, then the student will remove metal items and be scanned again. If an item cannot be removed, the operator shall visually check the person’s explanation of the article causing activation (e.g. jewelry, belt buckle) or may lightly touch the article causing the activation.
Unannounced searches may be conducted at any time during the school day. The search itself will be conducted in a manner that is reasonably related to its objectives and is not excessively intrusive in light of the age/sex of the student and the nature of the infraction.
School authorities may inspect and search school property and equipment owned or controlled by the school (such as desks and outdoor recess area), as well as personal effects left there by a student, without notice to or consent of the student. Students have no reasonable expectation of privacy in these places or areas.
The Director may request the assistance of law enforcement officials to conduct inspections and searches of desks, outdoor recess area, and other school property and equipment for illegal drugs, weapons, or other illegal or dangerous substances or materials, including searches conducted with the use of specially-trained dogs.
If a search produces evidence that the student has violated or is in violation of the law or the program’s policies, then such evidence may be seized and impounded by school authorities, and disciplinary action may be taken. The student’s parent/guardian will be notified as soon as possible and a written report will be completed; copies of the report will be sent to the ROE #40 Regional Superintendent and to the Home School district. When appropriate, such evidence may be transferred to the law enforcement authorities.
